[內(nèi)容摘要]海上保險是一種古老的保險制度，可保利益在海上保險制度中扮演著重要的角色，它是構(gòu)成海上保險合同的主要條件�？杀＠�益這一概念最早是在《1746年英國海上保險法》中出現(xiàn)的，而當時的學(xué)者將可保利益僅僅視為所有權(quán)。隨著海上保險制度的發(fā)展，這種樸素認識的狹隘性很明顯地顯現(xiàn)出來。本文將從海上保險的保險標的與可保利益，海上保險可保利益的定義、構(gòu)成要件和作用，主要的海上保險可保利益以及具有海上保險可保利益的時間幾個方面對海上保險的可保利益這一問題作簡單論述。
