論國際法上的集體安全制度—以黎以沖突為視角

  摘   要

最近爆發(fā)的黎巴嫩和以色列的沖突是2006年的國際時政熱點。此熱點蘊涵著1些集體安全問題。本文從介紹該熱點開始，引出對集體安全法概念的介紹，提出了集體安全法的6點法律特征和3點法律作用。集體安全的立法分為聯合國內集體安全的立法和聯合國外集體安全的立法。在現實國際社會中，兩者之間的關系不好處理。在執(zhí)法方面，作者結合黎以沖突個案發(fā)現并論述集體安全法執(zhí)法過程中存在的否決權問題、禁止使用武力或威脅的限度問題以及自衛(wèi)的問題。針對這些問題，作者提出了對策。

ABSTRACT

The recent conflict erupted between Lebanon and Israel was hot spot for international current spot. This hot spot is containing some collective security questions. This article will start from the introduction of the hot spot, which will draw out to the concept explanation of Collective Security Law, and then put forward to six law characteristics and the three-point method law effect of the Collective Security Law. The Collective Security legislation is divided into in the United Nations the collective security legislation and the union overseas collective security legislation. In the reality of international society, the relations between both are hard to handle. In the law enforcement aspect, I take the conflict between Lebanon and Israel as a case and then discuss the problems of veto, the prohibition of use military force or threatening and self-defense during the process of enforcing the Collective Security Law. In view of these questions, the author proposed the countermeasures.
