  GOING BACK AND GETTING IT RIGHT

  By almost every measure, Paul Pfingst is an unsentimental prosecutor. Last week the San Diego County district attorney said he fully intends to try suspect Charles Andrew Williams, 15, as an adult for the Santana High School shootings. Even before the tragedy, Pfingst had stood behind the controversial California law that mandates treating murder suspects as young as 14 as adults.

  So nobody would have wagered that Pfingst would also be the first D.A. in the U.S. to launch his very own Innocence Project. Yet last June, Pfingst told his attorneys to go back over old murder and rape convictions and see if any unravel with newly developed DNA-testing tools. In other words, he wanted to revisit past victories--this time playing for the other team. "I think people misunderstand being conservative for being biased," says Pfingst. "I consider myself a pragmatic guy, and I have no interest in putting innocent people in jail."

  Around the U.S., flabbergasted defense attorneys and their jailed clients cheered his move. Among prosecutors, however, there was an awkward pause. After all, each DNA test costs as much as $5,000. Then theres the unspoken risk: if dozens of innocents turn up, the D.A. will have indicted his shop.

  But nine months later, no budgets have been busted or prosecutors ousted. Only the rare case merits review. Pfingsts team considers convictions before 1993, when the city started routine DNA testing. They discard cases if the defendant has been released. Of the 560 remaining files, they have re-examined 200, looking for cases with biological evidence and defendants who still claim innocence.

  They have identified three so far. The most compelling involves a man serving 12 years for molesting a girl who was playing in his apartment. But others were there at the time. Police found a small drop of saliva on the victims shirt--too small a sample to test in 1991. Today that spot could free a man. Test results are due any day. Inspired by San Diego, 10 other counties in the U.S. are starting DNA audits.

  I watched through blurred vision as my husband, Chuck, walked away with his ex-wife.

  As a second wife, I was jealous of my stepchildren"s mother. I complained about her and her husband within earshot of my stepkids, and even grumbled about buying my stepchildren extras on top of paying child support. Somehow I overlooked the important fact that my stepchildren were the innocent ones thrust into a blended family.

  Then one day at a gathering of my own family, I watched as my mother went up to my stepmother and gave her a hug. I turned and saw my father and stepfather laughing together. Having always appreciated the cooperative relationship my parents and stepparents had, it occurred to me that Chuck"s children longed for the same. So Chuck and I decided to work hard at bridging gaps instead of creating them.

  It wasn"t easy, and changes didn"t come overnight, but they did come. By the time Conan was fifteen, a peace had settled between parents and stepparents. Instead of griping about child-support payments, we voluntarily increased them. And finally Conan"s mom gave us copies of his report cards and football schedules.

  I was proud of my kids and stepkids. After graduation, my stepdaughter married, and she and her husband built a house together. At seventeen, Conan had become a sensible, intelligent young man. With rugged good looks and a deep, baritone voice, I wondered what fortunate girl would snatch him up.

  Is language, like food, a basic human need without which a child at a critical period of life can be starved and damaged? Judging from the drastic experiment of Frederick II in the thirteenth century, it may be. Hoping to discover what language a child would speak if he heard no mother tongue, he told the nurses to keep silent.

  All the infants died before the first year. But clearly there was more than lack of language here. What was missing was good mothering. Without good mothering, in the first year of life especially, the capacity to survive is seriously affected.

  Today no such severe lack exists as that ordered by Frederick. Nevertheless, some children are still backward in speaking. Most often the reason for this is that the mother is insensitive to the signals of the infant, whose brain is programmed to learn language rapidly. If these sensitive periods are neglected, the ideal time for acquiring skills passes and they might never be learned so easily again. A bird learns to sing and to fly rapidly at the right time, but the process is slow and hard once the critical stage has passed.

  Experts suggest that speech stages are reached in a fixed sequence and at a constant age, but there are cases where speech has started late in a child who eventually turns out to be of high IQ. At twelve weeks a baby smiles and makes vowel-like sounds; at twelve months he can speak simple words and understand simple commands; at eighteen months he has a vocabulary of three to fifty words. At three he knows about 1,000 words which he can put into sentences, and at four his language differs from that of his parents in style rather than grammar.

  Recent evidence suggests that an infant is born with the capacity to speak. What is special about man’s brain, compared with that of the monkey, is the complex system which enables a child to connect the sight and feel of, say, a toy-bear with the sound pattern “toy-bear.” And even more incredible is the young brain’s ability to pick out an order in language from the mixture of sound around him, to analyze, to combine and recombine the parts of a language in new ways.

  But speech has to be induced, and this depends on interaction between the mother and the child, where the mother recognizes the signals in the child’s babbling (咿呀學(xué)語), grasping and smiling, and responds to them. Insensitivity of the mother to these signals dulls the interaction because the child gets discouraged and sends out only the obvious signals. Sensitivity to the child’s non-verbal signals is essential to the growth and development of language.

  As Gilbert White, Darwin, and others observed long ago, all species appear to have the innate capacity to increase their numbers from generation to generation. The task for ecologists is to untangle the environmental and biological factors that hold this intrinsic capacity for population growth in check over the long run. The great variety of dynamic behaviors exhibited by different population makes this task more difficult: some populations remain roughly constant from year to year; others exhibit regular cycles of abundance and scarcity; still others vary wildly, with outbreaks and crashes that are in some cases plainly correlated with the weather, and in other cases not.

  To impose some order on this kaleidoscope of patterns, one school of thought proposes dividing populations into two groups. These ecologists posit that the relatively steady populations have density-dependent growth parameters; that is, rates of birth, death, and migration which depend strongly on population density. The highly varying populations have density-independent growth parameters, with vital rates buffeted by environmental events; these rates fluctuate in a way that is wholly independent of population density.

  This dichotomy has its uses, but it can cause problems if taken too literally. For one thing, no population can be driven entirely by density-independent factors all the time. No matter how severely or unpredictably birth, death, and migration rates may be fluctuating around their long-term averages, if there were no density-dependent effects, the population would, in the long run, either increase or decrease without bound . Put another way, it may be that on average 99 percent of all deaths in a population arise from density-independent causes, and only one percent from factors varying with density. The factors making up the one percent may seem unimportant, and their cause may be correspondingly hard to determine. Yet, whether recognized or not, they will usually determine the long-term average population density.

  The military in Sri Lanka said on Wednesday that fierce confrontations between government troops and Tamil Tiger rebels occurred Tuesday in Puthukudiyiruppu, the last stronghold held by the rebels in the northern Mullaittivu district.

  The United Nations and the United States have renewed their calls for an end to hostilities in Sri Lanka and asked concerned parties to find a political solution to the ethnic conflict.

  The LTTE launched their armed campaign in the mid-1980s to set up a separate homeland for the minority Tamils in the north and east, resulting in the killing of more than 70,000 people.
